These general terms and conditions of sale are fully applicable to any order placed on www.heurtierclassic.com.
If the above procedure has been followed, and if the claim is proven valid, due to the fact that the package and the articles are heavily damaged, www.heurtierclassic.com reserves the right, either, to refund the price paid by the customer, or to make a new delivery of the ordered item. If the delivery is not quantitatively or qualitatively in accordance with the order, and in case the customer wishes to keep the received items, www.heurtierclassic.com agrees to refund only the possible price difference between the ordered products and those delivered, only if the delivered products are of lower prices than those ordered and paid. The ordered item will be either exchanged or refunded as soon as possible.
13 - LITIGATION/ MEDIATION
In the event of a dispute, if the buyer is a consumer within the meaning of the legal provisions, he may resort, in case of dispute, to conventional mediation or any other alternative mode of amicable settlement of disputes. If the buyer’s dispute concerns the contractual relationship with a distributor or repairer, he must first address his distributor or repairer. In the event of a dispute, if the buyer is a merchant, the competent court will be that of the domicile of the seller.
ARTICLE 12 - DELIVERY PROBLEMS CAUSED BY THE CARRIER
Upon receipt of the package, the consumer must check the condition of the package in the presence of the delivery person (or in the presence of staff for deliveries at HEURTIER Classic point of sale). If the consumer finds that his package is damaged, incomplete or has been opened, he must refuse the package. HEURTIER Classic will then settle the dispute with the carrier. Any anomaly regarding the articles (damaged, missing article compared to the order form, damaged or opened parcel, broken article...) must be reported within 48 hours of delivery by addressing to HEURTIER Classic (La Poste stamp is valid) a letter setting out the said complaints, or by email to contact@heurtierclassic.com.
ARTICLE 13 - DELIVERY ERRORS
Once the package has been received, the customer must check the conformity of his order. Any claim of delivery error and/or non-conformity of the products must be addressed to the merchant on the same day of delivery or no later than 48 working hours following delivery.
There are two scenarios for the consumer:
• One of the products received does not correspond to the indications on the order form present in the Customer Account (reference error). Customer must contact HEURTIER Classic. HEURTIER Classic will bear the return costs and send the correct reference to the customer as soon as possible.
• One of the products is missing: the consumer must address his complaint to HEURTIER Classic. After checks HEURTIER Classic will return at its expense the missing product to the customer if there was an omission on his part. In the event that our verifications prove that the product has been sent to the customer, no refund or return of said product will be made by HEURTIER Classic.
ARTICLE 14 - PORT CHARGES
All products sold on www.heurtierclassic.com come from our store or supplier stock. The delivery date is given as an indication and depends in particular on our supply orders. In case of non-compliance with the indicated deadline, no claim for compensation for delay will be accepted, and the delay cannot cause the cancellation of the order.
In-store pickup: ALWAYS FREE
The user can pick up the products ordered on www.heurtierclassic.com from the merchant directly. Orders can be withdrawn the same day for any order placed before 3 pm, if the product is actually available, excluding vehicle sales.
Customs and related charges: For orders delivered outside the EEC, customs and VAT fees may be charged upon receipt of the order by the customer. HEURTIER Classic does not participate in any way in the payment of such fees.
ARTICLE 15 DATA PROCESSING AND FREEDOMS
The information requested from the customer is necessary for processing his order. The customer has, at any time, a right of access, rectification and deletion of data concerning him, under the conditions provided for by law of 6 January 1978.

Welcome to www.heurtierclassic.com, a website for the sale of vehicles, equipment, accessories, new and used parts for cars and motorcycles. We invite you to read carefully these general terms of use and the general conditions of sale (hereinafter referred to as "CGU/ CGV") as well as our personal data protection policy to be able to browse and order on our website. The user, natural person, customer or not, is informed that he is bound by this. The use of our site services, as well as any order implies the prior acceptance, full and complete of these GCU/ CGV and our personal data protection policy that you acknowledge having read. These general terms and conditions of sale apply to all uses of the site and orders placed on the website www.heurtierclassic.com from metropolitan France. HEURTIER Classic reserves the right to adapt or modify these general terms of sale at any time. In case of modification, the CGU/ CGV in force on the day of the order will be applied to each order. ARTICLE 2 - CONDITIONS OF ACCESS
The present CGU/ GTC are intended to define the rights and obligations of the parties and the conditions applicable to any visit and/ or purchase made through the merchant site of HEURTIER Classic, www.heurtierclassic.com, whether the buyer is a professional or individual. These GCU/ GTC therefore constitute a contract between the company HEURTIER Classic and the user/ customer. The site is accessible free of charge to any user with an internet access. The user is responsible for his computer equipment and internet access. All costs related to the access to the site remain at the expense of the user/ client. The user will only be able to access his account after identification using his username and password. The user is obliged to keep his username/ password secret and must not disclose them to a third party.

HEURTIER Classic will do its best to resolve any problem as soon as possible. By creating his account, the user accepts these GCU/ GTC and our personal data protection policy. The creation of an account on the site is reserved for any natural person at least 18 years old. Each user can create only one account. Access to services includes subscription to HEURTIER Classic newsletters. The user has the possibility to modify the information he wishes to receive or to unsubscribe by clicking on the link provided for this purpose at the bottom of each newsletter. All fields in the account creation form must be filled out except for those fields indicated as optional. Failure to reply will result in the account not being created. All information provided by the user must be accurate. When the user creates an account on the site, he receives an email confirming the creation of the account on the same day. HEURTIER Classic reserves the right to delete any account that does not comply with these contractual conditions.
ARTICLE 3 - USE OF THE SITE
The Products/service(s) are presented on the site with a description enabling the buyer to know their essential characteristics and their price. The buyer selects the product/service(s) he or she wishes to purchase. He confirms his choice of product(s)/service(s) and acknowledges and accepts these GCS Marketplace by creating his account. The buyer receives an email confirming that his order has been accepted. The Seller is informed by HEURTIER Classic that one or more of the Products he has referenced on the Marketplace have been ordered by a buyer. The Seller undertakes to confirm the order(s) of the Buyer within 2 (two) working days. In the absence of confirmation of the order within 2 (two) working days, the contract concluded between the Buyer and the Seller is automatically cancelled and each of the parties is released from its obligations. In particular, the Buyer is assured that his bank account will not be debited. The seller agrees to comply with a 48 (forty-eight) hour deadline for shipping the product. The product will be deemed to have been received within thirty (30) days from the date of shipment. Product offers and prices are valid as long as they are listed on www.heurtierclassic.com as available. In this context, information on the availability of products by store is provided to you at the time of placing your order. When it is able to do so, HEURTIER Classic will offer the consumer the possibility of providing him with a good of an equivalent quality and price.
Pre-order registration and processing:
When ordering on www.heurtierclassic.com, the customer will have the opportunity to collect the product from the seller, or be delivered to the desired address upon confirmation of his «Cart» (excluding vehicle sale). After the payment of the customer, he will receive a confirmation e-mail with the different information and the contact details of the chosen merchant(s) during said order.
Order confirmation and preparation:
The merchant will confirm the taking into account and preparation of your order by an e-mail summarizing the products ordered.
If you have chosen home delivery (excluding vehicle sales): The merchant will then proceed to packing and shipping the product(s) within 48 working hours.
If you have chosen a collection in store: The merchant will then proceed to packing the product(s), on the same day for any order placed before 3 pm (according to the opening hours of the merchant)
The processing of certain orders requires a delay of up to 7-10 working days. This varies according to the goods ordered. All prices mentioned on this e-mail include VAT and any other taxes or contributions that may be imposed by law. You are responsible for the products as soon as they are taken over by you. HEURTIER Classic reserves the right to cancel any order that has not been withdrawn at the end of the withdrawal period. Transfer of ownership of products:
HEURTIER Classic retains full and complete ownership of the products sold until full payment of all amounts due in connection with your order, including all fees and taxes.
ARTICLE 4 - ACCEPTANCE AND PROOF
The acceptance of the GCU/ GTC is deemed to be acquired when the user navigates on the website www.heurtierclassic.com and when the customer clicks on the "order" button of the shopping cart page. This constitutes an irrevocable and unreserved acceptance of the order by the customer. The electronic records, kept in the computer systems of HEURTIER Classic under optimal security conditions, will be considered as evidence of communications, orders and payments between the parties. The customer agrees to clearly indicate the address at which delivery will be made during business hours. The customer agrees to pay the price indicated for the article to be delivered, delivery can only be made after receipt of payment of said order by www.heurtierclassic.com. The customer undertakes to take responsibility for compliance with the laws in force concerning the installation and use of the ordered equipment. The customer undertakes to make all necessary insurance arrangements for the installation and use of the ordered equipment.
ARTICLE 5 - PRODUCT INFORMATION
www.heurtierclassic.com presents on its website the products for sale and the necessary characteristics in accordance with article L 111-1 of the Consumer Code, allowing the user/ customer to know before the final order the essential characteristics of the products he wants to buy.
ARTICLE 6 - RIGHT OF WITHDRAWAL, EXCHANGE AND REFUND MODALITE
The customer has, in accordance with the law, a withdrawal period of 14 (fourteen) days from delivery of the products (and multiple order snacks with delivery in several times, from the receipt of the last product) and can return thosehere at the end of exchange or refund. Returns are to be made in their original condition and complete (accessories, notice...) allowing their re-marketing in new condition, and, if possible, accompanied by a copy of the purchase invoice for optimized management. Any impairment of the product resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the product, your liability may be incurred. You can exercise your right of withdrawal by any means to HEURTIER Classic and in particular by post or email (contact@heurtierclassic.com) expressing your willingness to withdraw without any ambiguity, and mentioning the order concerned by this withdrawal. In case the customer wishes to cancel an order already received, the customer undertakes to return this order at his own expense to the address of the seller (merchant concerned). In case of receipt of an order after cancellation, the customer undertakes to resend this order at its expense to the address of the seller (merchant concerned).
Return of the correct product
The customer must return to us the product purchased on www.heurtierclassic.com for which he exercised his right of withdrawal. If the customer does not return the correct product, HEURTIER Classic will send an e-mail inviting him to retrieve it at his expense, and this within 2 (two) months from the date of the e-mail. After this period, HEURTIER Classic will consider itself to be the owner within the meaning of article 2276, paragraph 1 of the Civil Code which provides: "In terms of furniture, possession is a title. In addition, if the property subject to the right of withdrawal is not returned, HEURTIER Classic reserves the right to file a complaint for breach of trust (article 314-1, paragraph 2 provides that: "breach of trust is punished by 3 (three) years of imprisonment and €375,000 in fines").
ARTICLE 7 - SPECIFIC PROVISIONS

The customer is solely responsible for direct and indirect damage, and violations committed, caused by purchasing and/or using the items purchased from www.heurtierclassic.com or any other website or distributor marketing in any way the items provided through www.heurtierclassic.com
ARTICLE 8 - PRICES
The total price shown when placing an order via www.heurtierclassic.com is the final price. Prices are quoted in euros (EUR).
ARTICLE 9 - PAYMENT METHOD
The customer can pay for their order using one of the following payment methods:

- Cheques (an additional delay applies due to the time it may take for the bank to cash them)
- Cash
In order to guarantee you maximum security, we may ask you to prove your identity and your address. This is done to protect you from fraudulent transactions, which could happen if someone with bad intentions were to retrieve your bank information. Through these documents, we guarantee you a better security, by making sure that you are the owner of the payment method used. This request for proof of identity/ address must receive a return from the customer within 2 days following the request made by HEURTIER Classic. If the customer does not respond after this period, HEURTIER Classic reserves the right to automatically cancel the order concerned, without any possibility of subsequent claim.
ARTICLE 10 - WARRANTY
All articles sold by HEURTIER Classic on the www.heurtierclassic.com site are subject to a legal guarantee of conformity (L211-1 of the Consumer Code) and a warranty against hidden defects (articles 1641 and following of the Civil Code) Allowing him to return defective items. The customer has 2 (two) years to claim any of these warranties. For non-conformity, the period runs from the date of issue. For hidden defects, the period runs from the time the defect is discovered. HEURTIER Classic cannot be held responsible for the misuse and/ or intensive use of the articles that could make the customer. Similarly, HEURTIER Classic cannot be held responsible for the return of a product not sold on the site by the customer. It is the customer’s responsibility to return the correct product.
Article L211-4 of the Consumer Code: The seller is obliged to deliver a good in accordance with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for defects of conformity resulting from the packaging, assembly instructions or installation when this has been placed on his account by the contract or was carried out under his responsibility.
